Terms of Service

1. Acceptance of Terms

The Enowise platform (“Service”) is provided by Enowise P.C. (TIN: 802092030, Paraschou 24, 11473 Athens, Greece). By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. If you are using the Service on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Enowise is the all-in-one platform for wineries, comprising three integrated modules:

  • ScanForFacts: EU e-label compliance, technical sheet generation, tasting events, and dynamic QR codes
  • WineKite: winery profile publishing, wine experience management, and booking request handling for wine tourism
  • WineryOps: vineyard and winery operations management (coming soon)

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Each company or organisation may register only one account unless expressly authorised by Enowise. Creating multiple accounts to obtain additional free credits or circumvent subscription requirements is prohibited and may result in account suspension.

4. Free Tier, Subscriptions, and Billing

A free tier is available with limited credits (e-labels, technical sheets, events, and dynamic QR codes). WineKite profile publishing and booking management are free during early access. Paid ScanForFacts subscriptions are billed annually and automatically renew unless cancelled before the renewal date. You may upgrade your plan at any time, with prorated charges applied for the remainder of your billing cycle. Prices are exclusive of applicable taxes unless otherwise stated. Per-period credits reset at each billing cycle. Dynamic QR codes count toward a total you can maintain. All fees are non-refundable except as required by applicable law.

5. User Content and Accuracy

You retain ownership of all content you upload to the Service, including wine data, images, and brand information. By uploading content, you grant Enowise a license to store, process, and display it as necessary to provide the Service. Content published on WineKite is visible to consumers. E-label content is publicly accessible via QR codes to comply with EU regulations.

You are solely responsible for the accuracy of all content you provide, including nutrition declarations and ingredients lists. Enowise does not warrant the accuracy of e-label content if the underlying data provided by you is false, misleading, or inaccurate.

6. Data Protection

We process your data in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR). Your data is stored within the European Union.

7. Limitation of Liability

To the maximum extent permitted by law, Enowise shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid for the Service in the twelve months preceding the claim.

8. Cancellation and Termination

Either party may terminate the agreement at any time. Upon cancellation of a ScanForFacts subscription, all existing e-labels and QR codes remain accessible for consumers with no time limits and no extra charges. We can redirect your QR codes to another provider upon request. Upon account deletion, your personal data will be removed within 30 days, unless otherwise required by law.

9. WineKite Bookings

WineKite facilitates booking requests between visitors and wineries. Enowise is not a party to any booking agreement between the visitor and the winery. The winery is solely responsible for fulfilling accepted bookings. Enowise does not process payments for bookings; payment is handled directly between the visitor and the winery.

10. E-Label Regulatory Disclaimer

The e-label content generated through our platform reflects our interpretation of EU wine labelling regulations. It is not intended as legal advice. Regulations may change, and we recommend consulting official sources for the latest requirements. We disclaim liability for any consequences arising from reliance on the regulatory information provided through the Service.

11. Indemnification

You agree to indemnify and hold harmless Enowise, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or the inaccuracy of any content you provide.

12. Force Majeure

Enowise shall not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, strikes, or other events of force majeure.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Greece. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.
